Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and DM NATIVE governing your use of the DM NATIVE application and related services (the "Service"). By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the higher minimum age of digital consent in your country) to use DM NATIVE. By using the Service you represent that you meet this requirement and that you are not barred from using it under any applicable law.

3. Your Account & Security

You are responsible for the activity on your account and for keeping your device, credentials, and cryptographic keys secure. Verification is performed via a one-time code sent to your phone or email. You agree to provide accurate registration information and to notify us promptly of any unauthorised use of your account.

4. The Service

DM NATIVE provides end-to-end encrypted messaging, voice and video calls, media sharing, optional translation and AI reply suggestions, AI voice notes synthesized from typed text, and Alias Groups. Because we never hold your encryption keys, we cannot access the content of your communications.

5. Acceptable Use

You agree not to use the Service to: (a) break any law or infringe others' rights; (b) distribute malware, spam, or phishing; (c) harass, threaten, stalk, or defame any person; (d) share content that is unlawful, hateful, or that you have no right to share; (e) attempt to disrupt, reverse-engineer, overload, or gain unauthorised access to the Service or its infrastructure; or (f) use automated means to abuse the Service. We may suspend or terminate accounts that violate these rules.

6. Child Safety — Zero Tolerance

Child sexual abuse material (CSAM) and any sexual exploitation of minors are strictly prohibited and result in immediate termination. We cooperate with the National Center for Missing & Exploited Children (NCMEC) and law-enforcement authorities, and will report and act on credible information of child exploitation to the extent required and permitted by law.

7. Voice Notes & Impersonation

The voice-note feature synthesises speech from text on your device. You may not use it, or any other feature, to impersonate any person — living or deceased — or to deceive recipients about the origin or authenticity of a message. Violations may result in immediate termination.

8. Alias Groups & Accountability

Alias Groups are pseudonymous: your alias hides your identity from other members, but your underlying account remains known to DM NATIVE and, where applicable, the group administrator. We reserve the right to suspend or ban users who abuse aliases to harass, threaten, defraud, or distribute illegal content.

9. Your Cryptographic Responsibility

You are solely responsible for the confidentiality of your cryptographic keys. Because we never hold your keys, if you lose your local keys we have no mechanism to recover your account, messages, or media. You understand and accept this trade-off as the basis of the Service's security.

10. Your Content

You retain all rights to the content you create and send. Because your content is end-to-end encrypted, we do not access, claim, or license it. You are solely responsible for the content you transmit and for ensuring you have the rights to share it.

11. Intellectual Property

The DM NATIVE application, brand, logos, and associated materials are owned by us and protected by applicable intellectual-property laws. These Terms grant you a limited, personal, non-transferable, revocable licence to use the app; they do not grant you any right to our trademarks or to copy, modify, or redistribute the application except as permitted by law.

12. Third-Party Services

The Service relies on third-party providers (for example, for verification codes, push notifications, and edge infrastructure) as described in our Privacy Policy, and is distributed through the Apple App Store and Google Play, whose terms also apply. We are not responsible for third-party services we do not control.

13. Service Availability & Changes

We may modify, suspend, or discontinue features at any time, and the Service may be unavailable from time to time. We are not liable for any interruption or loss of data resulting from changes, maintenance, or events beyond our reasonable control.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

15. Limitation of Liability

To the maximum extent permitted by law, DM NATIVE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, messages, profits, or goodwill, arising from or relating to your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless DM NATIVE from any claims, damages, or expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

17. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. On account deletion, your data is handled as described in our Privacy Policy (30-day grace period, then permanent deletion).

18. Law Enforcement & Legal Requests

We comply with valid legal process. However, because messages, calls, and media are end-to-end encrypted and the keys never leave your device, we are technically unable to produce the content of your communications — we do not hold it and cannot decrypt it. In response to a lawful request we can provide only the limited account data described in our Privacy Policy.

19. Governing Law & Disputes

These Terms are governed by the laws of the United States of America, without regard to conflict-of-law rules, and any dispute will be subject to the exclusive jurisdiction of the competent courts of the United States. Where mandatory local consumer-protection law grants you additional rights, those rights are unaffected.

20. Changes to These Terms

We may update these Terms; material changes are reflected by the "last updated" date above and, where appropriate, notified in the app. Continued use after changes take effect constitutes acceptance.

21. General

If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or transfer of the Service. These Terms and the Privacy Policy are the entire agreement between you and DM NATIVE regarding the Service.
